In Re Real Page, Inc., Rental Software Antitrust Litigation (2022)

Background: Filed in October 2022, In Re Real Page, Inc., Rental Software Antitrust Litigation is an antitrust, class-action lawsuit brought against RealPage, a real estate management company, and dozens of major property owners in the U.S., including Greystar — the largest landlord in the nation. The lawsuit seeks relief from defendants’ using RealPage’s “revenue management” services as a mechanism for inflating and fixing rental prices and restricting the availability of rental units across major cities, including agreements to keep housing units vacant despite systemic housing shortages and homelessness across the country.

Impact: Since filing, 26 defendants have agreed to 27 settlements totaling about $142 million. Following JCL’s suit, the District of Columbia and the Department of Justice (DOJ) filed their own lawsuits that allege RealPage software has been used to undermine competition in the rental market. Greystar has since agreed with the DOJ to stop using anticompetitive rent-setting software. The JCL case is still ongoing.
